All sales are subject to verification of the vehicle's condition, title, and history at the time of purchase.

4. Consignment Services

Consignment vehicles are owned by their respective sellers. Midtown Motorsports acts solely as a broker to facilitate the sale. By submitting a vehicle for consignment, the seller represents that they are the rightful owner, that the vehicle is free of undisclosed liens, and that all information provided is accurate. A separate consignment agreement will outline the specific terms, fees, and responsibilities of each party.

5. Purchases and Deposits

Vehicle purchases require a written purchase agreement signed by both parties. Deposits, when accepted, are non-refundable unless otherwise specified in writing. Title and possession transfer only upon receipt of full payment in cleared funds.

6. Vehicle Inspections

Buyers are encouraged to inspect vehicles in person and obtain independent third-party inspections prior to purchase. While we strive to disclose all known material defects, vehicles are sold "AS-IS" unless otherwise specified in writing. No verbal warranties or guarantees are valid.

7. Test Drives and Showroom Visits

All showroom visits and test drives are by appointment only. Test drives may require a valid driver's license, proof of insurance, and signed liability waiver. Midtown Motorsports reserves the right to deny any test drive at our discretion.

8. Pricing and Payment

All prices are listed in U.S. Dollars and are subject to applicable taxes, registration fees, and documentation charges. Accepted payment methods will be communicated at the time of sale. We do not accept payment in cryptocurrency or any unverified financial instruments without prior approval.

9. Title and Registration

We will provide all necessary documentation to facilitate title transfer and registration in accordance with state and federal regulations. The buyer is responsible for any registration, taxes, and fees applicable in their jurisdiction.

10. Warranties and Disclaimers

Unless explicitly stated in writing, all vehicles are sold "AS-IS, WHERE-IS" with no expressed or implied warranties. Midtown Motorsports disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by law. Any manufacturer warranties or third-party service contracts will be disclosed at the time of sale.

11. Limitation of Liability

To the fullest extent permitted by law, Midtown Motorsports, LLC, its owners, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of this website, our services, or any vehicle sold or consigned. Our total liability for any claim shall not exceed the purchase price or commission paid for the vehicle in question.
